In short: Marigold gives general information about pregnancy. It is not medical advice, it is not a medical device, and it does not replace your midwife, doctor or pharmacist. You use it at your own discretion. In an emergency, call your local emergency number.
1. Who we are and what these terms cover
Marigold (“the app”) is published by Okan Berk Manavoğlu, an independent developer based in Türkiye (“we”, “us”). These Terms of Use apply to your use of the app and of this website. The app is also licensed to you under Apple’s Licensed Application End User License Agreement (Standard EULA); if the two conflict, these terms apply to the extent the law allows. By using Marigold you agree to these terms. If you do not agree, please do not use the app.
2. Who can use Marigold
You must be at least 18 years old, or the age of majority where you live, to use Marigold. If you are younger, you may use it only with the involvement of a parent or guardian.
3. Medical disclaimer — please read
General information only. Week-by-week content, the “Can I…?” safety library, the symptom guide, checklists, tips and every other text in the app are general educational information compiled from public health guidance. They are not medical advice and are not tailored to you.
Not a medical device. Marigold does not diagnose, treat, prevent, monitor or predict any disease or condition. It does not create a doctor–patient, midwife–patient or any other professional relationship.
Verdicts are summaries, not permissions. Labels such as “Safe”, “Caution” and “Avoid” summarise what public guidance generally says. Your own situation may be different. Always check with a qualified professional before eating, taking, using or doing something you are unsure about, and never start, stop or change a medicine because of the app.
Tools are personal records. The due-date calculator, kick counter, contraction timer, weight, water, vitamin and other trackers are for your own notes. They are not clinical measurements and may be inaccurate. Follow your care team’s advice on when to call them, whatever a tool shows.
Guidance changes and differs between countries. We try to keep content accurate and up to date and link to our sources, but medical guidance evolves and varies by country and by person. Content may contain errors or omissions or may not reflect the latest guidance.
Reminders can fail. Notifications depend on your device, its settings and the operating system and may be delayed or not delivered. Do not rely on them for anything time-critical, such as medicines or appointments.
Never delay care. Never ignore professional advice or delay seeking it because of something you read in Marigold. If you think you or your baby may be unwell — for example bleeding, severe pain, reduced movements, fluid leaking, a severe headache or vision changes — contact your maternity unit or call your local emergency number immediately.
4. Your responsibilities
Decisions about your health and your pregnancy are yours to make together with your care team. You are responsible for the information you enter, for keeping your device and its passcode secure, and for keeping backups of your data (You → Privacy & your data → Export a backup). Please do not misuse the app, try to reverse-engineer it, or copy its content for commercial use.
5. No warranty
To the fullest extent permitted by applicable law, Marigold and all of its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, timeliness, fitness for a particular purpose, non-infringement, or that the app will be uninterrupted or error-free.
6. Limitation of liability
To the fullest extent permitted by applicable law:
we are not liable for any decision you make, or any action you take or do not take, based on information in the app, or for any health outcome connected with it;
we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or opportunity, arising from or related to your use of, or inability to use, the app;
our total liability for all claims relating to the app is limited to the amount you paid for Marigold Plus in the twelve (12) months before the event giving rise to the claim, or, if you paid nothing, to USD 0.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law that applies to you — for example liability for death or personal injury caused by negligence, for gross negligence or wilful misconduct, or for fraud — and nothing affects your mandatory statutory rights as a consumer. Where the law does not allow a limitation, it applies only to the extent the law allows.
7. Marigold Plus, subscriptions and the Pregnancy Pass
Monthly subscription: charged to your Apple Account. If a free trial is offered, payment is taken when the trial ends unless you cancel at least 24 hours before it ends. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel it in your App Store account settings.
Pregnancy Pass: a one-time purchase that unlocks Marigold Plus without renewal.
Prices are shown in the app before you buy and may vary by country and change over time. Apple is the seller of record: payments, refunds and any statutory right of withdrawal are handled by Apple under its terms.
Core features — week-by-week guidance, the safety library, the symptom guide, the kick counter and the contraction timer — are free.
8. Third-party sources and links
Marigold links to third-party websites, such as the public health bodies we cite. We do not control and are not responsible for their content, availability or privacy practices.
9. Intellectual property
The app, its design and its content belong to us or our licensors and are protected by law. You receive a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, under these terms and the Apple Standard EULA.
10. Changes and availability
We may update the app and these terms. If a change is material, we will tell you in the app, and where required by law we will ask you to accept it again. We may change or discontinue features, or the app, at any time; paid features you have bought will be honoured as required by law.
11. Governing law
These terms are governed by the laws of the Republic of Türkiye, and the courts of Istanbul have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in your local courts where the law allows.
12. General
If any part of these terms is found invalid or unenforceable, the rest remains in effect. Not enforcing a right is not a waiver of it. These terms and the Apple Standard EULA are the entire agreement between you and us about the app.
